What this unlocks
- Retailers who exited kratom. A meaningful number of chains and independents dropped the category as policy rather than law. A product with no kratom in it is a different conversation with them.
- The states that prohibit kratom sale. Six of them. A corydalis-and-kava product is not what those prohibitions cover.
- No kratom-act age and signage obligations. We still recommend 21+ positioning as the responsible default — but it becomes your choice rather than a statutory requirement.
- The alcohol-alternative category, which is growing quickly and where kratom's regulatory baggage has kept brands out of channels that would otherwise take them.
The regulatory detail behind all of this.
The build
| Component | Role | Notes |
|---|---|---|
| Kava kavalactones | The base | Carries the relaxation character. Has its own labelling conventions in several markets — formulate and label deliberately. |
| Kanna Sceletium tortuosum | Mood | Contributes lift and social character rather than sedation. |
| 13-OH | Synergist | 25–40 mg per serving. Rounds the profile and fills out the middle. |
| Format | Usually a shot | The 60 ml fill suits this build particularly well — it reads as a social serve. |
Flavour matters more here than in a mitragynine product, because the occasion is social and the comparison in a customer's head is a drink rather than a supplement. Our stock flavour library covers the obvious ground and we can match an existing product. Shot formats.
What to be careful about
Removing kratom removes one body of regulation. It does not remove the others.
- Food and supplement law still applies — labelling, facility requirements, ingredient rules.
- Claims rules still apply. Kratom-free does not widen what you may say about what a product does. No disease claims, ever. The marketing guide.
- Do not claim state legality you have not verified. "50-state" is a claim about your finished product in every jurisdiction, and substantiating it is yours to do.
- Kava carries its own considerations, which are well documented and which your formulation and labelling should reflect.
Position it as its own product
The brands doing well with kratom-free lines sell them as their own thing — a social product for an occasion — rather than as a substitute for the kratom product they also sell. It will not taste the same, dose the same, or feel the same, and framing it as a replacement sets up a disappointed customer and a return.
Most brands we work with end up running both: a differentiated mitragynine line for the customers they have, and a kratom-free line for the channels they could not previously reach.
Common questions
If it contains no Mitragyna speciosa material, it does not meet the definition those statutes use. That is a statement about kratom statutes specifically — other rules governing consumable products still apply, and you should verify each market with your own counsel. Detail here.
If it is accurate across every input — including flavour systems and any pre-blended material — that is a factual statement about composition. Be able to document it.
Liquid shots, and the 60 ml fill most often. It reads as a social serve rather than a supplement dose. Shot formats.
No, and we would not sell it to you as though it would. It is a different product for a different occasion. Run both.
