How to use this table — and its limits
This is a starting point for your counsel, not a compliance determination. State law in this area changes quickly, emergency rules are common, and local ordinances can restrict products that state law permits. The kratom-status column reflects our general understanding as of August 2026 and must be verified for every market you sell into. The corydalis column reflects the scope definitions those statutes use, which is a more stable point but still yours to confirm.

Why the third column is uniform
State kratom statutes — whether they prohibit kratom or regulate it through a consumer-protection framework — share a structural feature: they define what they cover by reference to Mitragyna speciosa, its leaf, and its alkaloids. Florida's is representative, defining a kratom product as something for human consumption containing any part of the leaf or an extract, synthetic alkaloid, or synthetically derived compound from it.
A product containing 13-OH and no Mitragyna speciosa material does not meet that definition. It is not within the statute's scope, so the statute's age restrictions, labelling requirements, registration obligations, and prohibitions do not attach to it by their terms.
This cuts both ways, and the second half matters. A product containing both mitragynine and 13-OH is within scope, because the mitragynine is there. Adding a corydalis alkaloid does not create an exemption. This is the most common misunderstanding we encounter.
What this means in practice
- Kratom-free products reach markets kratom cannot. Including the six states where kratom sale is prohibited outright, and retailers who have dropped the category as a matter of policy rather than law. The kratom-free path.
- MIT + 13 products carry the same obligations as your current mitragynine products. No more, no less.
- Local ordinances still apply. Counties and municipalities regulate independently, and a state-legal product can be restricted locally.
- Verify before every launch. Not once, and not from a table on a supplier's website — including ours.
Verifying this yourself
Check your state legislature's statute database for the current text of any kratom statute, your state agriculture or health department for implementing rules and emergency rules, and your state attorney general for scheduling actions. Emergency rules in particular move fast and are easy to miss. Our tracker records the changes we become aware of, but it is not a substitute for checking your own markets.
